Please answer the following questions:

1. Is it permissible to kill ISIS members and those like them without the permission of the Imam?

2. Is it permissible to carry out martyrdom operations, either initially or in response to the suicide operations of ISIS members and those like them?

Please note the following points:

1. It is not permissible to kill a human being except with the permission of a just Imam to prevent the means that lead to chaos, and he does not grant permission to kill a Muslim unless he has killed a human being whom Allah has forbidden to kill, or is a corrupter on the earth; as one of our companions informed us, he said:

«سَمِعْتُ الْمَنْصُورَ الْهَاشِمِيَّ الْخُرَاسَانِيَّ يَقُولُ: لَا يُحِلُّ دَمَ امْرِئٍ مُسْلِمٍ إِلَّا قَتْلُ النَّفْسِ الَّتِي حَرَّمَ اللَّهُ أَوْ فَسَادٌ فِي الْأَرْضِ، فَقَدْ قَالَ اللَّهُ تَعَالَى: ﴿مَنْ قَتَلَ نَفْسًا بِغَيْرِ نَفْسٍ أَوْ فَسَادٍ فِي الْأَرْضِ فَكَأَنَّمَا قَتَلَ النَّاسَ جَمِيعًا[1]، قُلْتُ: أَمَّا قَتْلُ النَّفْسِ الَّتِي حَرَّمَ اللَّهُ فَقَدْ عَرَفْتُهُ، فَمَا الْفَسَادُ فِي الْأَرْضِ؟ قَالَ: مَنْ أَضَلَّ قَوْمًا عَنْ سَبِيلِ اللَّهِ، أَوْ أَخَافَ النَّاسَ عَلَى أَنْفُسِهِمْ وَأَمْوَالِهِمْ، أَوِ ارْتَدَّ عَنْ دِينِهِ مُجَاهِرًا، أَوْ زَنَى وَهُوَ مُحْصَنٌ، فَقَدْ أَفْسَدَ فِي الْأَرْضِ»; “I heard Mansoor Hashemi Khorasani say: ‘Nothing makes the blood of a Muslim lawful except for killing a human being whom Allah has forbidden (to kill) or spreading corruption on the earth; because Allah has said: “Whoever kills a human being, except (as a punishment) for killing a human being or (spreading) corruption on the earth, it is as if he has killed all people.”’ I said: ‘As for killing a human being whom Allah has forbidden, I know it, but what is corruption on the earth?’ He said: ‘Whoever misleads people from the way of Allah, causes people to fear for their lives and their properties, openly renounces his religion, or commits adultery while being married has indeed spread corruption on the earth.’”

Yes, every Muslim must repel an oppressor who assaults him, his family, or his property by any means possible. If he kills him in self-defense, there is no sin on him if there is no other way than killing to repel him. If he asks Muslims for help, they must help him according to the bond of guardianship among believers, the obligation to forbid wrong, and the words of Allah Almighty, where He has said: ﴿فَإِنْ بَغَتْ إِحْدَاهُمَا عَلَى الْأُخْرَى فَقَاتِلُوا الَّتِي تَبْغِي حَتَّى تَفِيءَ إِلَى أَمْرِ اللَّهِ[2]; “And if one of them transgresses against the other, then fight against the one that has committed transgression until he returns to the command of Allah.” However, if two oppressive rulers are in conflict, or an oppressive subject rebels against an oppressive ruler, it is not permissible to help either one of them due to the absolute impermissibility of helping an oppressor, whether he is a ruler or a subject, and whether he is the ruler of the country where the Muslim lives or from another country, unless one of the oppressors is a Muslim and the other is a not-Muslim, in which case it is necessary to help the Muslim oppressor against the non-Muslim oppressor so that the non-Muslim does not gain power over the Muslim, considering the words of Allah Almighty, where He has said: ﴿وَلَنْ يَجْعَلَ اللَّهُ لِلْكَافِرِينَ عَلَى الْمُؤْمِنِينَ سَبِيلًا[3]; “Allah has never set a way for disbelievers against believers”; as one of our companions informed us, he said:

«سَمِعْتُ الْمَنْصُورَ يَقُولُ: إِذَا رَأَيْتُمْ جَبَّارَيْنِ يَقْتَتِلَانِ بِرَمْلٍ فَذَرُوهُمَا يَحْثُو أَحَدُهُمَا عَلَى الْآخَرِ حَتَّى يَهْلِكَ الْأَعْجَزُ! قُلْتُ: أَرَأَيْتَ إِنْ كَانَ أَحَدُهُمَا مِنَ الشِّيعَةِ وَالْآخَرُ مِنَ السُّنَّةِ؟ قَالَ: ذَرُوهُمَا، قُلْتُ: أَرَأَيْتَ إِنْ كَانَ أَحَدُهُمَا مُسْلِمًا وَالْآخَرُ يَهُودِيًّا؟ قَالَ: إِذَا كَانَ ذَلِكَ فَأَعِينُوا الْمُسْلِمَ، لِكَيْ لَا يَغْلِبَ عَلَيْكُمُ الْيَهُودِيُّ فَيَسُبَّ نَبِيَّكُمْ، وَيُحْرِقَ كِتَابَكُمْ، وَيَهْدِمَ مَسَاجِدَكُمْ»[4]; “I heard Mansoor say: ‘Whenever you see two tyrants fighting on sand, leave them to throw (sand) at each other until the weaker one perishes! (i.e., do not interfere.)’ I said: ‘What do you say if one of them is a Shia and the other a Sunni?’ He said: ‘Leave them.’ I said: ‘What do you say if one of them is a Muslim and the other a Jew?’ He said: ‘If so, then help the Muslim so that the Jew will not gain power over you to revile your Prophet, burn your Book, and destroy your mosques.’”

2. It is not permissible for a Muslim to intentionally kill himself along with his enemy; because Allah Almighty has forbidden the killing of oneself absolutely; as He has said: ﴿وَلَا تَقْتُلُوا أَنْفُسَكُمْ[5]; “And do not kill yourselves,” and said: ﴿وَلَا تُلْقُوا بِأَيْدِيكُمْ إِلَى التَّهْلُكَةِ[6]; “And do not cast yourselves into destruction with your own hands.” There is nothing in the Sunnah that restricts this prohibition; since the Messenger of Allah (peace and blessings of Allah be upon him and his family) did not command it, and it is not proven that any of the Sahabah did it; regardless of the fact that the Sunnah cannot abrogate or specify the Quran[7], and the end certainly does not justify the means in Islam. This means that it is not permissible to achieve what is permitted, which is killing the enemy, through what is forbidden, which is killing oneself; because what is permitted is not achieved through what is forbidden, and Mansoor Hashemi Khorasani (may Allah protect him) has pointed out that it is one of the works of the time of ignorance; as one of our companions informed us, he said:

«سَأَلْتُهُ عَنِ الْمُسْلِمِ يَحْمِلُ فِي جَيْبِهِ قُنْبُلَةً، فَيَرْمِي حَتَّى إِذَا نَفِدَتْ سِهَامُهُ وَقَرُبَ مِنْهُ الْكَافِرُ فَجَّرَهَا، فَقَتَلَهُ وَقَتَلَ نَفْسَهُ، قَالَ: هَذَا مِنْ عَمَلِ الْجَاهِلِيَّةِ، كَانَ إِذَا أُحِيطَ بِأَحَدِهِمْ فِي الْحَرْبِ يُنَادِي: «اقْتُلُونِي وَفُلَانًا»، فَيَقْتُلُهُ وَيَقْتُلُ نَفْسَهُ! فَمَكَثَ هُنَيَّةً ثُمَّ قَالَ: مَا أَلْفٌ مِنَ الْكُفَّارِ بِرَجُلٍ مِنَ الْمُسْلِمِينَ، فَلَا تَفْعَلُوا»[8]; “I asked Mansoor about a Muslim who carries a bomb in his pocket, then he shoots until his bullets run out and a disbeliever approaches him, then he detonates the bomb and kills him and kills himself (with him) too. He said: ‘This is one of the works of the time of ignorance. When one of them was surrounded in battle, he would call out: “Kill me with so-and-so.” So he would kill him and kill himself!’ Then he paused for a moment and then said: ‘A thousand disbelievers are not worth a Muslim man, so do not do this.’”
