In addition, the basis of intellectuals in affairs that belong to God is cited by His command, although it is not cited by His command in affairs that belong to themselves, and therefore, their basis in their own affairs, such as construction and medicine, is not their basis in affairs that belong to God, such as practicing the religion, and it is clear that God’s command in matters that belong to Him is to achieve certainty, which is not possible by imitating mujtahids. As a result, the intellectuals’ going to builders and doctors does not necessitate their going to mujtahids in religion, and the analogy between these two is a false analogy.

[Impossibility of scholars’ ijtihad based on their imitation]

In addition, they reproach any Muslim who has abandoned imitating their scholars and referred to more authentic sources of Islam that with the permission of which marja‘ has he abandoned imitation and turned to ijtihad in it; because in their opinion, a mujtahid is permitted to do ijtihad only if another mujtahid issues a fatwa permitting his ijtihad; while this is also a false infinite regress and clear sophistry; because imitating such a person is contingent on imitating the one who has issued a fatwa that imitating him is permissible; while imitating that person is also contingent on imitating the one who has issued a fatwa that imitating him is permissible, and so on, which is neither finite nor practical.

[Impossibility of absolute guardianship of the Islamic jurist]

In addition, a group of them in countries such as Iran exaggerate their scholars and believe that they are appointed by God and guardians like the Prophet, and they obey them as they obey God and the Prophet; like Jews about whom God Almighty has said: ﴿اتَّخَذُوا أَحْبَارَهُمْ وَرُهْبَانَهُمْ أَرْبَابًا مِنْ دُونِ اللَّهِ[1]; “They took their scholars and monks as lords apart from God”; considering that they certainly did not pray or fast to please their scholars, but rather they obeyed them apart from God, and this was hidden polytheism for them. While Muslim scholars, no matter how righteous they are, are not infallible in what they say and do, and this is what they admit themselves, and therefore, it is not possible for them to be appointed by God and guardians like the Prophet;
