Mansoor Hashemi Khorasani
(69) Mansoor Hashemi Khorasani rejects imitation from scholars with the reason that it is just useful for conjecture and conjecture does not have authority in Islam and he knows it one of the causes for divisions of Muslims since long time ago to this day. Yet further he does not even consider Ijtihad to its commonplace meaning which is interpreting laws from conjectural reasoning, correct with regards to invalidity of conjectural reasoning in Islam and he knows it necessary to figure out another solution to achieve certainty. (Article 1)

1 . أَخْبَرَنَا عَبْدُ الشَّكُورِ بْنُ زُلْمَيَ الْوَرْدَكِيُّ، قَالَ: كَانَ لِي صَدِيقٌ مِنْ أَهْلِ بَامِيَانَ، وَكَانَ يَبْحَثُ عَنِ الْكَنْزِ، فَدَعَانِي إِلَى ذَلِكَ عَلَى أَنْ يَكُونَ لِي نِصْفُهُ، فَقُلْتُ: حَتَّى أَسْأَلَ الْمَنْصُورَ، فَكَتَبْتُ إِلَيْهِ أَسْأَلُهُ عَنْ ذَلِكَ، فَكَتَبَ إِلَيَّ بِخَطِّهِ: لَا يَبْحَثُ عَنِ الْكَنْزِ إِلَّا سَفِيهٌ، وَمَنْ وَجَدَهُ فَلْيُؤَدِّ خُمُسَهُ، فَإِنَّهُ مِنَ الْغَنِيمَةِ

Translation of the Letter:

Abd al-Shukur ibn Zulmi Wardaki informed us, he said: I had a friend from Bamyan who was looking for treasure, so he invited me to do so in exchange for half of it to be for me, so I said: I should ask Mansoor, then I wrote a letter to his honor and asked him about this work, so he wrote to me in his own handwriting: Nobody looks for treasure except for a fool, and whoever finds it must pay the Khums of it; because it is booty.

2 . أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ حَبِيبٍ الطَّبَرِيُّ، قَالَ: كَتَبْتُ إِلَى الْمَنْصُورِ أَسْأَلُهُ عَمَّا يَجِبُ فِيهِ الْخُمْسُ، فَكَتَبَ إِلَيَّ بِخَطِّهِ: اعْلَمْ يَرْحَمُكَ اللَّهُ أَنَّ كُلَّ مَا يَرْزُقُكَ اللَّهُ مِنْ حَيْثُ لَا تَحْتَسِبُ فَفِيهِ الْخُمْسُ، كَالْغَنِيمَةِ، وَالْكَنْزِ، وَالْمَعْدِنِ، وَالْحِلْيَةِ الَّتِي تَسْتَخْرِجُهَا مِنَ الْبَحْرِ، وَالْهِبَةِ، وَالْجَائِزَةِ، وَالْفَائِدَةِ الْكَبِيرَةِ الَّتِي تَفْضُلُ عَنْ مَؤُونَتِكَ، وَالْمِيرَاثِ الَّذِي لَا تَحْتَسِبُهُ مِنَ الْبَعِيدِ، وَالْمَالِ الَّذِي تَكْنِزُهُ فَلَا تَأْكُلُ مِنْهُ وَلَا تُنْفِقُهُ فِي سَبِيلِ اللَّهِ إِذَا حَالَ عَلَيْهِ الْحَوْلُ، فَعَلَيْكَ فِي ذَلِكَ الْخُمْسُ تُخْرِجُهُ إِلَى خَلِيفَةِ اللَّهِ فِي الْأَرْضِ وَالْيَتَامَى وَالْمَسَاكِينِ وَابْنِ السَّبِيلِ مِنْ آلِ هَاشِمٍ، إِنْ كُنْتَ آمَنْتَ بِاللَّهِ وَمَا أَنْزَلَ عَلَى عَبْدِهِ يَوْمَ الْفُرْقَانِ يَوْمَ الْتَقَى الْجَمْعَانِ، وَاللَّهُ عَلَى كُلِّ شَيْءٍ قَدِيرٌ.

Translation of the Letter:

Abdullah Ibn Habib Tabari informed us, he said: I wrote to Mansoor and asked him about things in which Khums is obligatory, so he wrote to me in his own handwriting: Know -may God have mercy on you- that whatever God provides you from where you do not imagine, there is Khums for it, such as booty and treasure and mine and ornament that you take out of the sea and gift and reward and huge profit that is more than your expenses and inheritance that you do not expect from distant (relative) and the money you store, then you do not use it and you do not spend in the way of God whenever a year passes on it, so its Khums is obligatory on you to bring it to the Caliph of God on earth and the orphans and the poor and the travelers from the family of Hashim, if you believe in God and what is with His servant on the day of separation -the day when the two groups met- and God has power over everything!
